Intellectual property of the Company is protected through a combination of patent, trademark, copyright and trade secret laws, employee and third-party nondisclosure/confidentiality agreements and license agreements. Provisional patents related to Genesis technologies were filed in 2008, and U.S. utility patents were applied for in July 2009 and March 2011. International rights were addressed in December 2009 by filing under the Patent Cooperation Treaty (“PCT”) with additional international patents filed in strategically selected foreign countries in June 2011. Each of these foreign patent applications is based on the July 2009 U.S. utility patent. U.S. Federal Trademark protection for the Clear Energy Systems, Genesis 1000 and related marks has been initiated. The Company anticipates applying for additional patents in the future as new products, processes and components are developed.
